الملخص:
أدى التطور الذي عرفه مجال تكنولوجيا الإعلام والاتصال، إلى ظهور نمط جديد من العقود، تعرف بــ "العقود الالكترونية"، ولمواكبة هذه التحولات الرقمية المتسارعة، حرص المشرع الجزائري من خلال القانون 18-05 المتعلق بالتجارة الإلكترونية والقوانين ذات الصلة به على إرساء منظومة قانونية خاصة لتنظيم هذه العقــود بحيث تراعي طبيعــتها المستحدثة وخصوصية البيئة الرقمية التي تبرم وتنفذ في إطارها، وذلك بهدف الحد من المخاطر المرتبطة بها. وقد ساهمت هذه المنظومة في تكريس مقومات الأمن القانوني في العقود الالكترونية من خلال توفير بيئة رقمية آمــنة تضمن سلامة تبادل المعلومات والمعطيات الإلكترونية، وتعمل على تحقيق الثقة في هذه العقود بما يكفل استقرار المراكز القانونية للمتعاقدين، لاسيما المستهلك الإلكتروني باعتباره الطرف الضعيف فيها. Abstract: The development of the field of information and communication technology has led to the emergence of a new type of contracts, known as "electronic contracts". In order to keep pace with these accelerating digital transformations, the Algerian legislator, through Law 18-05 on Electronic Commerce and related laws, has been keen to establish a special legal system to regulate these contracts so that they take into account their developed nature and the specificity of the digital environment with in which they are concluded and implemented, with the aim of reducing the risks associated with them. This system has contributed to establishing the elements of legal security in electronic contracts by providing a secure digital environment that ensures the safety of exchanging information and electronic data, and works to achieve confidence in these contracts in order to ensure the stability of the legal centers of contractors, especially the electronic consumer as the weak party in them. |
