الملخص
تناول هذه المذكرة بالبحث والتحليل المنهجي، بناء فكريا موضوعه أساليب تشكيل المؤسسة التشريعية في الجزائر بين الانتخاب والتعيين والضوابط التنظيمية البنيوية و الأطر القانونية الناظمة لذلك من خلال استعراض السياق التاريخي لتطورها من الإستقلال إلى غاية اخر تعديل دستوري 2020، مع التركيز في خضم هذا المسار التطوري على التحول و الإنتقال الذي شهده نظام المجلس التشريعي بالجزائر منذ سنة 1996 من صورة المجلس الواحد إلى صورة نظام المجلسين. الدراسة تهدف في جانبها الأكاديمي إلى تبيان الأسس الدستورية التي تبرر اسلوبي الانتخاب و التعيين في الجزائر، وتحليل طبيعة العلاقة بين المجلس الشعبي الوطني ومجلس الأمة، ومدى مساهمة الانتخاب و التعيين في تحقيق التوازن والاستقرار داخل السلطة التشريعية. Abstract This memorandum should be examined, through systematic research and analysis, the conceptual framework of the methods of forming the legislative institution in Algeria between election and appointment, as well as the structural organizational controls and the legal frameworks governing them. It reviews the historical context of its development from independence up to the latest constitutional amendment of 2020, with particular emphasis on the transformation and transition experienced by Algeria’s legislative council system since 1996, moving from a unicameral system to a bicameral one. From an academic perspective, the study aims to clarify the constitutional foundations that justify the use of both election and appointment in Algeria, and to analyse the nature of the relationship between the National People’s Assembly and the Council of the Nation, as well as the extent to which election and appointment contribute to achieving balance and stability within the legislative authority. |
