الملخص:
خلصت هذه الدراسة المقارنة والتحليلية للمنظومة التشريعية العقارية في الجزائر إلى استنتاج جوهري مفاده: أن المشرع الجزائري قد أحدث تحولاً جذرياً في فلسفة استغلال الأراضي الفلاحية التابعة للأملاك الوطنية الخاصة، من خلال الانتقال من الأنظمة التقليدية (كالانتفاع الدائم) إلى "نظام الامتياز الفلاحي" بموجب القانون رقم 10-03، معتبراً إياه الآلية القانونية المثلى لتحقيق التوازن الاستراتيجي بين حماية الرقبة العقارية للدولة وتحفيز الاستثمار الفلاحي الفعلي. تُوجت الدراسة باستنتاج استشرافي يؤكد أن أزمة العقار الفلاحي في الجزائر ليست أزمة نصوص تشريعية، بل هي أزمة تفعيل ومتابعة ميدانية؛ حيث يتوقف نجاح هذا النظام القانوني على مدى جدية الهيئات الإدارية المحلية والمركزية في تفعيل سلطة الرقابة ومكافحة ظاهرتي الإهمال والمضاربة العقارية. Abstract: This analytical study culminates in a core legislative conclusion: The Algerian legislator has initiated a radical shift in the philosophy of exploiting state-owned private agricultural lands, transitioning from traditional usufruct systems to the "Agricultural Concession System" under Law 10-03. This system serves as the optimal legal framework designed to reconcile the protection of state property rights with the promotion of actual agricultural investment. The thesis concludes with a forward-looking insight: the core challenge facing Algerian agricultural land is not a lack of legislation, but rather an enforcement and field-monitoring deficit. The ultimate success of this legal regime depends heavily on the rigorous enforcement of oversight mechanisms by local and national institutions to eliminate land negligence and illegal conversion. |
