تتناكؿ ىذه ادلذكرة موضوع ادلسؤكلية اجلزائية للموثق يف التشريع اجلزائرم،مربزةن دكره احملورم كضابط
عمومي يف ربقيق األمن القانوين كاستقرار ادلعامالت. كتستعرض الدراسة االزدكاجية القانونية اليت ؼلضع ذلا ادلوثق، حيث تًتتب عليو مسؤكلية جزائية مشددة دبوجب قانوف العقوبات كالقوان ُت اخلاصة (كمكافحة الفساد، تبييض األمواؿ، كالتشريعات اجلبائية) عند إخاللو بواجباتو أك استغالؿ صفتو. كما ربلل ادلذكرة كفالة الضماناتع ب ُت محاية ادلصلحة العامة كاالقتصاد الوط ٍت من جهة، كالتوازف الذم أرساه ادلشر اإلجرائية كادلهنية حلماية ادلوثق أثناء ادلتابعة كاحملاكمة من جهة أخرل، لتخلص إىل ضركرة توحيد النصوص القانونية كتدقيق معاي َت التكييف القانوين لألخطاء. Abstract: This dissertation addresses the subject of the penal responsibility of the notary in Algerian legislation, highlighting their pivotal role as a public officer in achieving legal security and the stability of transactions. The study reviews the legal duality to which the notary is subjected, as they incur strict penal liability under the Penal Code and special laws (such as anti-corruption, money laundering, and tax legislation) upon breaching their duties or exploiting their status. The dissertation also analyzes the balance established by the legislator between protecting the public interest and the national economy on one hand, and ensuring procedural and professional guarantees to protect the notary during prosecution and trial on the other, concluding with the necessity of unifying legal texts and refining the criteria for the legal characterization of errors. |
