الملخص
تتناول هذه المذكرة دور القضاء الدستوري في تحقيق العدالة الدستورية من خلال ضمان احترام مبدأ سمو الدستور وحماية الحقوق والحريات الأساسية. كما تبرز آليات الرقابة الدستورية سواء السياسية أو القضائية، ودور المحكمة الدستورية في مراقبة دستورية القوانين عبر الإخطار أو الدفع بعدم الدستورية. وتوضح المذكرة كيف يساهم القضاء الدستوري في تحقيق التوازن بين السلطات ومنع تعسف السلطة التشريعية أو التنفيذية. كما تتناول مفهوم العدالة الدستورية باعتبارها ضمانة لترسيخ مبدأ المساواة وسيادة القانون. وفي الأخير، تؤكد على أن القضاء الدستوري يمثل أداة فعالة لإلغاء النصوص غير الدستورية وتعزيز دولة القانون. Abstract This thesis examines the role of constitutional justice in achieving constitutional justice by ensuring the supremacy of the Constitution and protecting fundamental rights and freedoms. It highlights the mechanisms of constitutional review, whether political or judicial, and the role of the Constitutional Court through referral and the exception of unconstitutionality. The study shows how constitutional justice contributes to maintaining the balance between powers and preventing abuse by legislative and executive authorities. It also explains constitutional justice as a guarantee of equality and the rule of law. Ultimately, it confirms that constitutional justice is an effective tool for annulling unconstitutional laws and strengthening the rule of law. |
