ملخص: تناولت هذه الدراسة موضوع الوصاية على الجماعات المحلية في الجزائر باعتبارها آلية قانونية تهدف إلى ضمان احترام مبدأ المشروعية وحسن سير الإدارة المحلية وتحقيق المصلحة العامة. وقد تم التطرق إلى مفهوم الوصاية الإدارية ومختلف صور الرقابة وآليات تطبيقها في الواقع العملي.
كما سلطت الدراسة الضوء على أهم الإشكالات والصعوبات التي تواجه تطبيق نظام الوصاية، خاصة ما يتعلق بتأثيره على استقلالية الجماعات المحلية ومدى تكريس مبدأ اللامركزية الإدارية. وتوصلت الدراسة إلى ضرورة تحقيق التوازن بين الرقابة الإدارية واستقلالية الجماعات المحلية، من خلال تقليص التدخل الإداري غير الضروري، وتعزيز اللامركزية، ودعم الجماعات المحلية بالإمكانيات المالية والبشرية اللازمة لتحقيق التنمية المحلية الفعالة وتحسين التسيير الإداري. Abstract: This study addressed the subject of supervision over local communities in Algeria as a legal mechanism aimed at ensuring respect for the principle of legality, the proper functioning of local administration, and the achievement of the public interest. The study also dealt with the concept of administrative supervision, the various forms of control, and the mechanisms of their application in practical reality. The study also highlighted the most important problems and difficulties facing the application of the supervision system, especially with regard to its impact on the independence of local communities and the extent to which the principle of administrative decentralization is consolidated. The study concluded that it is necessary to achieve a balance between administrative control and the independence of local communities by reducing unnecessary administrative intervention, strengthening decentralization, and supporting local communities with the financial and human resources necessary to achieve effective local development and improve administrative management. |
