الملخص: يبحث هذا العمل في طبيعة العلاقة بين القضاء والتحكيم التجاري، منطلقًا من فرضية أنها علاقة تكاملية لا تنازعية؛ فالتحكيم يستمد كيانه من إرادة الأطراف لكنه يبقى عاجزًا عن فرض القوة الإلزامية لأحكامه دون مظلة القضاء. يتجسد هذا التكامل عبر دور مساند يظهر في تشكيل هيئة التحكيم وسير الخصومة، ودور رقابي لاحق يبرز عند الاعتراف والتنفيذ دون التدخل في موضوع النزاع. استند البحث إلى القانون 09-08 الجزائري، خاصة المادتين 1016 و1056، فضلًا عن اتفاقيتي نيويورك وواشنطن. وتكشف الدراسة أن حدود هذا التدخل القضائي هي الضامن الحقيقي لفعالية التحكيم كعدالة موازية للقضاء الرسمي.
ABSTRACT This study examines the nature of the relationship between the judiciary and commercial arbitration, starting from the premise that it is a complementary rather than conflictual relationship; arbitration derives its existence from the parties' will, yet remains unable to impose the binding force of its awards without judicial support. This complementarity manifests through a supportive role during the constitution of the arbitral tribunal and the proceedings, and a subsequent supervisory role during recognition and enforcement, without intervening in the merits of the dispute. The research relied on Algerian Law 09-08, particularly Articles 1016 and 1056, as well as the New York and Washington Conventions. The study reveals that the limits of this judicial intervention constitute the true guarantee of arbitration's effectiveness as a justice system parallel to state courts. |
