ملخص المذكرة
تناولت هذه الدراسة موضوع "تنظيم القضاء العسكري في الجزائر"، وهو موضوع يكتسي أهمية بالغة بالنظر إلى الطبيعة الخاصة للمؤسسة العسكرية من جهة، وضرورة تكريس دولة القانون وضمانات المحاكمة العادلة من جهة أخرى. تهدف الدراسة إلى تبيان كيفية تنظيم وهيكلة الجهات القضائية العسكرية، وتحديد اختصاصاتها، ورصد المسار الإجرائي للدعوى العمومية العسكرية في ظل التعديلات التشريعية الأخيرة، ولاسيما القانون رقم 18-14 وقد توصلت الدراسة إلى أن المشرع الجزائري قد خطى خطوات عملاقة نحو عصرنة العدالة العسكرية، خاصة من خلال تكريس مبدأ التقاضي على درجتين عبر استحداث مجالس الاستئناف العسكرية، وإخضاع الأحكام لرقابة المحكمة العليا، مما جعل القضاء العسكري قضاءً متخصصاً لا استثنائياً. كما خلص البحث إلى أن إجراءات التحقيق والمحاكمة العسكرية، رغم خصوصيتها المرتبطة بالانضباط العسكري، تضمن حقوق الدفاع بما يتماشى مع المبادئ العامة للعدالة. Abstract This study examines the "Organization of the Military Judiciary in Algeria," a topic of paramount importance given the unique nature of the military institution and the necessity of upholding the rule of law and fair trial guarantees. The research aims to clarify the structural organization of military judicial bodies, define their jurisdictions, and monitor the procedural path of military public prosecution in light of recent legislative amendments, particularly Law No. 14 – 18 The study concludes that the Algerian legislator has made significant strides toward modernizing military justice, notably by enshrining the principle of double degree of jurisdiction through the establishment of Military Courts of Appeal and subjecting military rulings to the supervision of the Supreme Court. This shift has transformed military justice into a specialized rather than an exceptional system. Furthermore, the research finds that military investigation and trial procedures, despite their connection to military discipline, safeguard defense rights in accordance with the general principles of justice. |
