ملخص الدراسة
تناولت الدراسة آلية الدفع بعدم دستورية القوانين في ظل التعديل الدستوري الجزائري لسنة 2020، باعتبارها وسيلة لتعزيز الرقابة الدستورية وحماية الحقوق والحريات. وهدفت إلى بيان مفهوم هذه الآلية وشروط ممارستها أمام المحكمة الدستورية، بالاعتماد على المنهج الوصفي التحليلي في دراسة النصوص الدستورية والقانونية ذات الصلة. وخلصت الدراسة إلى أن التعديل الدستوري لسنة 2020 عزّز نظام الرقابة الدستورية من خلال استحداث المحكمة الدستورية وتمكين الأفراد من إثارة الدفع بعدم الدستورية، بما يكرّس مبدأ سمو الدستور، غير أن فعالية هذه الآلية تبقى مرتبطة بتبسيط الإجراءات وتعزيز استقلالية المحكمة الدستورية. Study Summary: This study examined the mechanism of pleading the unconstitutionality of laws under the Algerian Constitutional Amendment of 2020, as a means of strengthening constitutional review and protecting rights and freedoms. The study aimed to clarify the concept of this mechanism and the conditions for its exercise before the Constitutional Court, relying on the descriptive-analytical method in examining the relevant constitutional and legal texts. The study concluded that the 2020 Constitutional Amendment strengthened the system of constitutional review through the establishment of the Constitutional Court and by enabling individuals to raise pleas of unconstitutionality, thereby reinforcing the principle of constitutional supremacy. However, the effectiveness of this mechanism remains dependent on simplifying procedures and strengthening the independence of the Constitutional Court. |
