ملخص الدراسة.
في إطار السعي لتحقيق التنمية المحلية ومواكبة للتحولات الفكرية والتشريعية في التنظيم الإداري، تجد الجماعات المحلية في الجزائر نفسها أمام حتمية تفعيل اللامركزية الإقليمية كخيار استراتيجي لإدارة الشؤون المحلية. ورغم توالي الإصلاحات القانونية والمؤسساتية الرامية إلى تعزيز صلاحيات الولاية والبلدية ومنحهما الاستقلالية ، إلا أن واقع التنمية المحلية لا يزال يواجه عقبات هيكلية تحد من فاعليته وتبرز الإشكالية في مدى قدرة التشريعات الحالية على تحرير المبادرة المحلية وتجاوز قيود الوصاية الإدارية والتبعية المالية للإدارة المركزية. حيث تسعى هذه الدراسة إلى تبيان مواطن الخلل في المنظومة القانونية الراهنة، وإشراف سبل بناء حوكمة محلية راشدة تلامس العقبات الحقيقية وتستجيب لمتطلبات التنمية المحلية. Within the framework of striving towards local development and keeping pace with intellectual and legislative shifts in administrative organization، local communities in Algeria find themselves compelled to activate territorial decentralization as a strategic choice for managing local affairs. Despite successive legal and institutional reforms aimed at strengthening the competencies of both the Wilaya and the Commune and granting them independence، the reality of local development still faces structural obstacles that limit its effectiveness. The core problematic lies in the extent to which current legislation can liberate local initiative and overcome the constraints of administrative tutelage and financial dependence on the central administration. Accordingly، this study seeks to identify the flaws within the current legal system and explore paths toward building sound local governance that addresses real obstacles and responds to the prerequisites of local development. |
