الملخص
تعتبر جريمة الاتجار بالبشر من أخطر الجرائم التي تهدد حقوق الإنسان وحرياته الأساسية، إذ تمثل الصورة الحديثة للرق والعبودية المعاصرة، وتمس مختلف فئات المجتمع سواء الأطفال أو النساء أو الرجال، وتتخذ صوراً متعددة كالسخرة القسرية والاستغلال الجنسي. كما تعد جريمة عابرة للحدود الوطنية ترتبط في الغالب بالشبكات الإجرامية المنظمة التي تسعى إلى نقل واستغلال الضحايا لتحقيق مكاسب مادية غير مشروعة، الأمر الذي جعلها تشكل تهديداً حقيقياً للأمن الإنساني والاجتماعي على المستويين الوطني والدولي، ونظراً لخطورة هذه الأفعال وتنامي آثارها، تدخل المشرع الجزائري من خلال ترسانته القانونية التي تهدف إلى الوقاية من جرائم الاتجار بالبشر ومكافحتها، وعلى رأسها القانون رقم 23-04 المتعلق بالوقاية من الاتجار بالبشر ومكافحته، وإلى جانب التعديلات التي مست قانون الإجراءات الجزائية بموجب القانون رقم 25-14 بما يواكب التطورات الحديثة في مجال مكافحة هذه الجرائم وآليات التصدي لها. Abstract Human trafficking is considered one of the most dangerous crimes threatening human rights and fundamental freedoms, as it represents the modern face of contemporary slavery and servitude. It affects various segments of society, including children, women, and men, and takes multiple forms such as forced labor and sexual exploitation. Furthermore, it is a transnational crime, mostly linked to organized criminal networks that seek to transport and exploit victims to achieve illicit material gains. This has made it a real threat to human and social security at both national and international levels. In view of the gravity of these acts and their growing impacts, the Algerian legislator intervened through a legal arsenal aimed at preventing and combating human trafficking crimes. Chief among these is Law No. 23-04 on the Prevention and Combating of Human Trafficking, alongside the amendments made to the Code of Criminal Procedure under Law No. 24-05, to keep pace with modern developments in combating these crimes and the mechanisms to counter them. |
