ملخص:
أصبح الاعتماد على الوسائل التقنية الحديثة في الإثبات الجنائي أمرا لابد منه نظرا للتطور التقني الحاصل والذي مس كافة جوانب الحياة، مما أدى إلى تطور أساليب الإجرام فأصبحت الوسائل التقليدية عاجزة عن إثبات هذا النوع من الجرائم، التي تعتمد بشكل كبير على استخراج الأدلة من الأجهزة الالكترونية: هاتف، حاسوب... لما تتميز به هذه الأدلة من دقة ويقينية تساعد في الفصل في القضية والوصول إلى الحقيقة. إلا أنّ هذا النوع من الأدلة تواجه تحدي عدم انتهاك خصوصية الأفراد وحياتهم الشخصية لذلك قيّدها المشرع بضوابط وقوانين للحرص على عدم الإخلال أو المساس بها ورعاية لحقوقهم. وهو الأمر الذي دفعنا لدراسة هذا الموضوع نظرا لأهميته في المجال الجنائي كونه أكثر تأثرا بالمستجدات التقنية فظهور هذه الأدلة يعد نقلة نوعية كبيرة في مجال الإثبات والتطور المستمر في المجال التقني يجعل منه موضوعا متجددا. Abstract: The reliance on modern technical means in criminal proof has become increasingly necessary due to the rapid technological revolution that has affected all aspects of life. This development has led to the evolution of criminal methods, making traditional means insufficient to prove this type of crime, which largely depends on extracting evidence from electronic devices such as telephones and computers. This evidence, due to its accuracy and reliability, helps in resolving cases and reaching the truth. However, this type of evidence faces the challenge of ensuring that individuals’ privacy and personal lives are not violated. Therefore, the legislature has established controls and laws to prevent any breach or infringement of rights and to ensure their protection. This has prompted the examination of this issue because of its importance in the criminal field, which is highly affected by technological developments. Evidence remains a major pillar in the field of criminal proof, and the continuous development in technology makes it a constantly renewed and evolving topic. |
