الملخص:
يشهد العالم اليوم تحولاً رقمياً متسارعاً انعكس بشكل جوهري على الأنشطة الاقتصادية ونمط المعاملات التجارية، حيث أضحت التجارة الإلكترونية أحد أهم مظاهر هذا التحول. وقد أفرزت هذه البيئة الجديدة تحديات قانونية كبيرة، خاصة فيما يتعلق بحماية الخصوصية الرقمية والمعطيات الشخصية للأفراد. تهدف هذه الدراسة إلى إبراز الإطار القانوني المنظم للتجارة الإلكترونية في الجزائر، مع التركيز على مدى فعالية التشريعات الوطنية في حماية الحقوق الرقمية للمستهلكين وضمان أمن المعاملات الإلكترونية. كما تتناول المذكرة أهم المعايير الدولية المؤثرة، وترصد التحديات العملية التي تعيق التطبيق السليم لهذه القوانين، وتقترح حلولاً لتعزيز الثقة والأمان في البيئة الرقمية الجزائرية. Abstract: The world is currently witnessing a rapid digital transformation that has fundamentally changed economic activities and the nature of commercial transactions, making e-commerce one of its most prominent features. This new environment has produced significant legal challenges, particularly regarding the protection of digital privacy and individuals' personal data. This study aims to highlight the legal framework regulating e-commerce in Algeria, focusing on the effectiveness of national legislation in safeguarding digital rights for consumers and ensuring the security of electronic transactions. The dissertation also examines key international standards, identifies the practical challenges hindering the proper implementation of these laws, and proposes solutions to enhance trust and security in Algeria’s digital landscape. |
