الملخص
يعد الطب الشرعي اليوم من الوسائل الأساسية في الإثبات الجنائي بما يقدمه من معطيات علمية دقيقة تساعد القاضي على فهم الوقائع و تكوين قناعة و قد تظم المشرع الجزائري هذا النوع من الخبرة ضمن نظام الخبرة القضائية في قانون الإجراءات الجزائية دون أن يمنح تقاريره حجية ملزمة ، لذلك يبقى للقاضي سلطة تقديرية في تقيم تقرير الطب الشرعي فيأخذ به كليا أو جزئيا أو سيستعبده بحسب ما يراه منسجما مع باقي عناصر الدعوى و في التطبيق العملي القضائي،يظهر أن التعامل مع هذه التقارير يختلف من قضية إلى أخرى حسب ظروف كل ملف والأدلة المتوفرة فيه. الكلمات المفتاحية : Abstract Forensic medicine has become one of the fundamental means of criminal evidence, as it provides precise scientific findings that assist judges in understanding the facts of a case and forming their judicial conviction. The Algerian legislator has incorporated this type of expertise into the judicial expertise system under the Algerian Code of Criminal Procedure. However, forensic medical reports are not granted binding evidentiary value. Consequently, judges retain discretionary authority to assess such reports, accepting them wholly or partially, or disregarding them whenever they consider them inconsistent with the other evidence presented in the case. In judicial practice, the treatment of forensic medical reports varies from one case to another depending on the circumstances of each case and the available evidence. |
