الملخص : يتناول هذا البحث موضوع الخطأ الطبي الموجب للمساءلة الجزائية في ضوء القانون رقم 18-11 المتعلق بالصحة، من خلال تحليل مفهوم الخطأ الطبي وشروط مشروعية العمل الطبي وصوره المختلفة، إضافة إلى دراسة معايير تقدير الخطأ الطبي ودور الخبرة الطبية في إثباته. كما يعالج نطاق المسؤولية الجزائية للطبيب والجرائم الطبية الخاصة مثل الاعتداء على سلامة جسم الإنسان، ونزع الأعضاء دون شروط قانونية، والمساعدة الطبية على الإنجاب المخالف للقانون، إلى جانب الجرائم الماسة بالآداب المهنية كإفشاء السر المهني وتحرير الشهادات الطبية الكاذبة. ويتطرق كذلك إلى الآثار المترتبة عن قيام المسؤولية الجزائية، سواء العقوبات الأصلية أو التكميلية، مع إبراز الضمانات القانونية المقررة للطبيب أثناء المتابعة الجزائية بما يضمن التوازن بين حماية المريض وضمان حقوق الممارس الطبي.
Abstract: This research addresses the issue of medical error giving rise to criminal liability in light of Law No. 18-11 relating to health, through the analysis of the concept of medical error, the conditions of legality of medical practice, and its various forms, in addition to studying the criteria for assessing medical error and the role of medical expertise in proving it. It also examines the scope of the physician’s criminal liability and specific medical crimes such as attacks on the integrity of the human body, organ removal without legal conditions, and medically assisted reproduction in violation of the law, as well as crimes affecting professional ethics such as breach of medical confidentiality and the issuance of false medical certificates. It further addresses the consequences resulting from the establishment of criminal liability, whether principal or supplementary penalties, while highlighting the legal guarantees granted to physicians during criminal proceedings to ensure a balance between patient protection and safeguarding the rights of medical practitioners. |
