الـملخص:
تتناول هذه الدراسة موضوع الحماية القانونية للمرأة السجينة في القانون الدولي والتشريع الجزائري، من خلال بيان الإطار المفاهيمي للمرأة السجينة والعوامل المؤدية إلى إجرام المرأة، مع إبراز مختلف الضمانات المقررة لحماية حقوقها في المواثيق الدولية ودور المنظمات الدولية في هذا المجال. كما تعالج الدراسة صور الحماية القانونية التي كرسها التشريع الجزائري لفائدة المرأة السجينة، سواء تعلق الأمر بالحقوق الصحية والاجتماعية والثقافية والمالية، أو بالحقوق المرتبطة بخصوصية المرأة السجينة كالحامل والأم، وظروف الاحتجاز والتفتيش وآليات الرقابة الداخلية. وقد خلصت الدراسة إلى أن المشرّع الجزائري أقر جملة من الضمانات القانونية انسجاماً مع المعايير الدولية، غير أن فعالية هذه الحماية تبقى رهينة بالتطبيق العملي وتحسين ظروف التكفل بالمرأة السجينة داخل المؤسسات العقابية. Abstract: This study addresses the issue of the legal protection of female prisoners in international law and Algerian legislation by presenting the conceptual framework of female prisoners and the factors leading to female criminality, while highlighting the various guarantees established for the protection of their rights in international conventions and the role of international organizations in this field. The study also examines the forms of legal protection established by Algerian legislation for female prisoners, whether related to health, social, cultural, and financial rights, or to rights linked to the specific status of female prisoners, such as pregnant women and mothers, conditions of detention and search procedures, as well as internal monitoring mechanisms. The study concluded that the Algerian legislator has established a set of legal guarantees in line with international standards; however, the effectiveness of such protection remains dependent on practical implementation and the improvement of care conditions for female prisoners within penal institutions. |
