تتناول هذه الدراسة الآليات القانونية لحماية النظام العام والآداب العامة في البيئة الرقمية، في ظل التحولات التي فرضتها الثورة الرقمية على المجتمع والقانون. واعتمدت الدراسة المنهج المقارن والتحليلي لبيان تطور مفهومي النظام العام والآداب العامة وانتقالهما إلى الفضاء الرقمي، مع إبراز خصوصيات البيئة الرقمية وما تطرحه من تحديات أخلاقية وقانونية. كما تم تحليل الإطار التشريعي الوطني والدولي والآليات المعتمدة لمكافحة الجرائم الإلكترونية وحماية الأمن السيبراني، إضافة إلى دور التقنيات الحديثة كالذكاء الاصطناعي والتشفير في تعزيز الحماية الرقمية. وخلصت الدراسة إلى أن فعالية الحماية القانونية تقتضي التكامل بين التشريع والتقنية، وتطوير التعاون الدولي، مع تحقيق التوازن بين حماية النظام العام وضمان الحقوق والحريات الأساسية.
This study examines the legal mechanisms for protecting public order and public morals within the digital environment, in light of the transformations brought about by the digital revolution on society and legal systems. The study adopted a comparative and analytical approach to explore the evolution of the concepts of public order and public morals and their transition into cyberspace, while highlighting the specific characteristics and challenges of the digital environment. It also analyzed the national and international legal frameworks and the various mechanisms adopted to combat cybercrime and enhance cybersecurity. Furthermore, the study addressed the growing role of modern technologies, particularly artificial intelligence and encryption, in supporting digital protection. The study concluded that the effectiveness of legal protection in the digital environment depends on achieving integration between legal and technological approaches, developing legislative frameworks, strengthening international cooperation, and maintaining a balance between the protection of public order and the respect for fundamental rights and freedoms. |
