يتناول هذا البحث موضوع الحق في الوصول إلى المعلومات في ظل رقمنة العمل الإداري في الجزائر، باعتباره من الحقوق الأساسية التي تعزز مبادئ الشفافية والمساءلة وتحسين جودة الخدمة العمومية. وقد سعت الجزائر من خلال تبني الإدارة الإلكترونية إلى تطوير الأداء الإداري وتسهيل حصول المواطنين على المعلومات والخدمات بطريقة رقمية حديثة. كما يبرز البحث الإطار القانوني والتنظيمي المنظم لهذا الحق، مع الوقوف على مختلف الإصلاحات والتشريعات الداعمة للتحول الرقمي. ويتناول كذلك دور الرقمنة في تكريس مبدأ الحكامة الإلكترونية وتعزيز الثقة بين الإدارة والمواطن. ورغم الجهود المبذولة، لا تزال هناك عدة تحديات تعيق التطبيق الفعلي لهذا الحق، من بينها ضعف البنية التحتية الرقمية ونقص الثقافة الإلكترونية. ويخلص البحث إلى ضرورة تعزيز الآليات القانونية والتقنية وتطوير الموارد البشرية لضمان فعالية الحق في الوصول إلى المعلومات. كما يؤكد على أهمية تحديث الإدارة العمومية بما يتماشى مع متطلبات التحول الرقمي والتنمية المستدامة.
Abstract This study examines the right of access to information in the context of the digitization of administrative processes in Algeria, recognizing it as a fundamental right that reinforces the principles of transparency and accountability and improves the quality of public services. Through the adoption of e-government, Algeria has sought to improve administrative performance and facilitate citizens’ access to information and services via modern digital means. The study also highlights the legal and regulatory framework governing this right, while examining the various reforms and legislation supporting the digital transformation. It also addresses the role of digitization in enshrining the principle of e-governance and strengthening trust between the administration and citizens. Despite the efforts made, several challenges continue to hinder the effective implementation of this right, including weak digital infrastructure and a lack of digital literacy. The study concludes that it is necessary to strengthen legal and technical mechanisms and develop human resources to ensure the effectiveness of the right to access information. It also emphasizes the importance of modernizing public administration in line with the requirements of digital transformation and sustainable development. |
