الملخص:
تتناول هذه الدراسة موضوع الرقمنة في مجال الصفقات العمومية في ظل القانون 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية، حيث كرس المشرع الجزائري التحول نحو الإدارة الإلكترونية بهدف تعزيز الشفافية ومكافحة الفساد وتحقيق النزاهة في التعاملات الإدارية. وقد أبرزت الدراسة أهمية البوابة الإلكترونية للصفقات العمومية باعتبارها آلية حديثة لتبسيط الإجراءات الإدارية، تسهيل الوصول إلى المعلومات، وتسريع معالجة الملفات، مع التقليل من التعاملات الورقية وإلغاء عاملي الزمان والمكان. كما توصلت الدراسة إلى أن الرقمنة تساهم في تحسين فعالية تسيير الصفقات العمومية وضمان مبدأ المساواة بين المتعاملين الاقتصاديين، غير أن نجاحها يبقى رهينا بتوفير بنية تحتية رقمية فعالة وتأهيل الموارد البشرية وضمان أمن المعطيات الإلكترونية. Abstract : This study examines the topic of digitalization in public procurement under Law 23-12, which sets out the general rules governing public procurement. The Algerian legislature has dedicated itself to the transition to e-government with the aim of enhancing transparency, combating corruption, and ensuring integrity in administrative transactions. The study highlights the importance of the electronic public procurement portal as a modern mechanism for simplifying administrative procedures, facilitating access to information, and expediting file processing, while reducing paperwork and eliminating the constraints of time and location The study also concludes that digitalization contributes to improving the efficiency of public procurement management and ensuring the principle of equality among economic . |
