يُعد موضوع تداخل الاختصاص بين مجلس الدولة والمحاكم الإدارية الاستئنافية من أهم الإشكالات التي أفرزها تطور القضاء الإداري في الجزائر، خاصة بعد استحداث المحاكم الإدارية الاستئنافية بموجب الإصلاحات التشريعية الأخيرة. ويهدف هذا البحث إلى دراسة مدى تأثير توزيع الاختصاص بين هاتين الجهتين القضائيتين على تحقيق العدالة الإدارية وضمان حسن سير القضاء. كما يتناول أوجه التداخل التي قد تنشأ نتيجة غموض بعض النصوص القانونية أو تعدد معايير الاختصاص، مع بيان دور الاجتهاد القضائي في معالجة هذه الإشكالات. وقد خلصت الدراسة إلى أن تحديد الاختصاص بصورة دقيقة يسهم في تعزيز الأمن القانوني، وتسريع الفصل في المنازعات الإدارية، مع التأكيد على ضرورة استكمال الإصلاحات التشريعية بما يحقق الانسجام بين مختلف درجات القضاء الإداري ويحد من حالات التنازع أو التداخل في الاختصاص.
Abstract: The overlap of jurisdiction between the State Council and the Administrative Courts of Appeal is one of the major issues resulting from the development of the administrative judiciary in Algeria, particularly following the establishment of the Administrative Courts of Appeal under the recent legislative reforms. This study aims to examine the impact of the distribution of jurisdiction between these two judicial bodies on the achievement of administrative justice and the proper functioning of the judicial system. It also addresses the areas of overlap that may arise due to the ambiguity of certain legal provisions or the multiplicity of jurisdictional criteria, while highlighting the role of judicial jurisprudence in resolving such issues. The study concludes that a precise determination of jurisdiction contributes to strengthening legal certainty, expediting the settlement of administrative disputes, and emphasizes the need to complete legislative reforms in order to ensure harmony among the different levels of the administrative judiciary and to reduce conflicts or overlaps in jurisdiction. |
