الملخص:
إن أهمية مبدأ المنافسة في ظل القانون 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية لا يمكن حصر جوانبها، وذلك أن مكانتها الأساسية هي أحد مقومات الحكم الراشد، وأحد آليات مكافحة الفساد علاوة على كونها هو من أهم الدعائم التي تقوم عليه التنمية. وبناءا على ما سبق فإن تجسيد هذا المبدأ يتطلب بدل جهد كبير من قبل المشرع الجزائري، من خلال سن النصوص القانونية وتفرض تطبيقها على أرض الواقع، ومن جهة أخرى تم تكريسها من طرف المصلحة المتعاقدة في مراحل إبرام الصفقة العمومية، بما يضمن بعث الثقة بين المشترك العمومي وبين المتعاملين الاقتصاديين ويحد من ظاهرة الفساد وحماية المال العام. Abstract: The importance of the principle of competition under Law 23-12, which sets out the general rules relating to public procurement, is multifaceted. Its fundamental role is that of a cornerstone of good governance, a mechanism for combating corruption, and one of the most important pillars of development. Therefore, realizing this principle requires significant effort from the Algerian legislature, through enacting legal texts and enforcing their implementation. Furthermore, it must be upheld by the contracting authority during the various stages of concluding public contracts, thereby fostering trust between the public sector and economic operators, reducing corruption, and protecting public funds. |
