ملخص
الكلمات المفتاحية: تنفيذ عقد الأشغال العامة ،إختلال التوازن المالي لعقد الأشغال ،فعل الأمير،ظروف خارجية،إستمرارية المرفق العام،التعويض. تعتبر الصفقة اعمومية للأشغال من أكثر الصفقات التي تعد وسيلة لإنشاء التجهيزات و المرافق العامة وأداة لإنشاء مشاريع الدولة ،وذاك من خلال تنفيذ برامجها التنموية و سياساتها العامة. غالبا ما يصطدم تنفيذ عقد الأشغال العامة بظروف جديدة لم يكن بالإمكان توقعها غير تلك التي ابرم في ضوئها العقد ،ويكون من شأن هذه الظروف التأثير على تنفيذ المتعاقد لالتزاماته التعاقدية و تزيد من أعبائه المالية و تؤدي الى قلب اقتصاديات عقد الأشغال العامة. و يكون مرد هذه الظروف الجديدة أحيانا تدخلات الإدارة في أحيان أخرى أفعال و ظروف خارجة عن إرادة المتعاقدين. Keywords: Execution of the public works contract .Disturbance of the financial balance of the public works contract .continuity of public service .insemination .external circumstances Among the most important forms of public procurement, are publicprocurement contracts for public works, since they are the means for the creation of public facilities and infrastructure and an instrument of the realisation of State projects through the implementation of its development programmes and public policies. Such circumstances may affect the contractor’s performance of contractual obligations, increase the financial burdens on the contractor and accordingly upset the financial balance of the public works contract. These new circumstances may, at times, arise from administrative intervention, while at other times they may result from acts of risk or events beyond the control and will of the contracting parties. |
