ملخص
تناولت هذه الدراسة النظام القانوني للمركز الدولي لتسوية منازعات الاستثمار (ICSID) باعتباره إحدى أهم الآليات الدولية المتخصصة في تسوية المنازعات الناشئة بين الدول المضيفة والمستثمرين الأجانب، وذلك من خلال دراسة الإطار القانوني الذي يحكمه وفقًا لـ، وبيان طبيعته القانونية، وشروط اختصاصه، وآليات تسوية المنازعات أمامه، والقانون الواجب التطبيق، إضافة إلى دراسة حجية أحكام التحكيم وآليات تنفيذها. وقد خلصت الدراسة إلى أن المركز يشكل إطارًا قانونيًا دوليًا مستقلًا يسهم في تعزيز حماية الاستثمار الأجنبي وتحقيق التوازن بين حقوق المستثمرين وسيادة الدول المضيفة، من خلال نظام تحكيمي يتميز بالحياد والفعالية، الأمر الذي ساهم في دعم الثقة في مناخ الاستثمار الدولي، مع التأكيد على أهمية تطوير قواعده وآلياته بما يواكب التطورات المتسارعة في مجال الاستثمار الدولي. Abstract This study examines the legal framework of the International Centre for Settlement of Investment Disputes (ICSID) as one of the leading international institutions specialized in the settlement of investment disputes between host States and foreign investors. It analyzes the legal framework governing the Centre under the , its legal nature, jurisdictional requirements, dispute settlement mechanisms, applicable law, and the binding force and enforcement of arbitral awards. The study concludes that ICSID provides an independent international legal framework that enhances the protection of foreign investment while maintaining a balance between the rights of foreign investors and the sovereignty of host States through a neutral and effective arbitration system. It further emphasizes the importance of continuously developing its legal rules and mechanisms to keep pace with the evolving landscape of international investment law. |
