الملخص:
تعتبر جريمة التزوير واستعمال المزور، من الجرائم التي عرفت انتشارا في المجتمع، ولأنها من الجرائم التي تمس بالثقة، ولما لها من تأثير على الأفراد والمؤسسات والإدارات، خصها المشرع بالقانون 24-02 المتعلق بمكافحة التزوير واستعمال المزور، والذي نص من خلاله على التدابير الوقائية التي تلزم المؤسسات باختلاف أنواعها باتخاذ إجراءات وقائية للحماية الجنائية للمحررات العمومية أو الرسمية ، كما نص على القواعد الإجرائية التي تتبع في البحث والتحري عن الجرائم ومرتكبيها ومعاقبتهم، ونص على إمكانية اللجوء إلى أساليب التحري الخاصة والتفتيش الإلكتروني كإجراء جديد، وهذا يتماشى مع طرق التزوير الحديثة المتصلة بتكنولوجيا الاعلام والاتصال وحسب مل تشهده الوسائل من تطورات وعصرنة القطاعات، وشجع كذلك على المساهمة في التبليغ عن الجريمة بإعفاء الفاعلين المبلغين عنها من العقاب أو تخفيف العقوبة. Abstract: The crime of forgery and the use of forger is considered one of the crimes that have been known to spread in society, and because it is one of the crimes that affect trust, and because of its impact on individuals, institutions and administrations, the legislator specific to the law 24-02 on combatting forgery and the use of forgers, through which it stipulated preventive measures that oblige institutions of all kinds to take preventive measures for the criminal protection of public or official editors. It also provided for the procedural rules that are followed in the search and investigation of crimes and their perpetrators and punishing them, and provided for the possibility of resorting to special investigation methods and electronic inspection as a new procedure, and this is in line with modern methods of forgery related to information and communication technology and according to the lack of developments and modernisation of the sectors, and also encouraged contributing to reporting the crime by exempting the reported actors from punishment.
