تعد دولة القانون من بين المبادئ الدستورية الحديثة التي تسعى الدول إلى تضمينها في دساتيرها، والعمل على تجسيدها على أرض الواقع، وذلك من خلال تجسيد عناصر قيامها من سمو الدستور وتدرج القوانين، والاعتراف بالحقوق والحريات، والرقابة على دستورية القوانين، إضافة إلى تكريس ضمانات قوية، تتجسد في الفصل بين السلطات وتطبيق النهج الديمقراطي واستقلال القضاء، إضافة إلى مواكبة التطورات الدولية بالتأكيد على تبني الحكم الراشد وتفعيل الأمن القانوني، وكغيرها من الدول سعت الجزائر إلى تبني عناصر وضمانات دولة القانون في دساتيرها، خاصة في دساتير القانون إلى غاية التعديل الدستوري لسنة 2020، الذي أرسى العديد من المكاسب في دولة القانون
The rule of law is among the fundamental principles of modern constitutional doctrine that states seek to embed within their constitutions and to translate into practical reality. This is achieved through the embodiment of its constituent elements — namely, the supremacy of the constitution, the hierarchy of laws, the recognition of rights and freedoms, and oversight of the constitutionality of laws — in addition to the establishment of robust guarantees manifested in the separation of powers, the application of the democratic approach, and the independence of the judiciary. This is complemented by keeping pace with international developments, with an emphasis on adopting good governance and activating legal security. Like other states, Algeria has sought to adopt the elements and guarantees of the rule of law within its constitutions, particularly in the constitutional amendments of 2020, which established numerous gains for the rule of law. |
