تناولت الدراسة موضوع آليات ممارسة الضبط الإداري البيئي كإستراتيجية وقائية متكاملة لحماية النظام العام البيئي وتحقيق التنمية المستدامة، موازنةً بين حرية الاستثمار وحماية الأوساط الحيوية.
كما تطرقت الدراسة إلى أبعاد هذا النظام في القانون الدولي العام من خلال المسار التاريخي للمؤتمرات العالمية والاتفاقيات الدولية الملزمة لحماية المناخ والأوزون والتنوع البيولوجي. وبيان انعكاس هذا الإطار الدولي في التشريع الجزائري عبر إقرار نظام تراخيص قبلية صارم يشمل رخص البناء ورخص استغلال المنشآت المصنفة، مدعوماً بمنظومة من الجزاءات الإدارية البعدية والإجراءات الردعية لفرض الامتثال للمعايير الإيكولوجية ومواجهة الجرائم البيئية المستحدثة. The study deals with the mechanisms of practicing environmental administrative control as an integrated preventive strategy to protect the environmental public order and achieve sustainable development, balancing economic investment with ecosystem preservation. The study also examines the dimensions of this system within public international law through the historical evolution of major global conferences and binding international treaties for climate, ozone, and biodiversity protection. Furthermore, it highlights how this international framework is reflected in Algerian legislation through a rigorous system of prior authorizations, including building permits and operating permits for classified installations, backed by a comprehensive set of subsequent administrative sanctions and deterrent measures designed to enforce ecological compliance and combat modern environmental crimes. |
