تتناول هذه
الدراسةمبادئ احملاكمة العادلة يف قانون اإلجراءات اجلزائية اجلزائري رقم25-14من خالل حتليل أهم ع اجلزائري يف خمتلف مراحل الدعوى اجلزائية. وهتدف إىل إبراز مدى استجابة هذاالضماانت اإلجرائية اليت كرسها املشر القانون ملتطلبات احملاكمة العادلة من خالل دراسة املبادئ اليت حتكم سري اإلجراءات اجلزائية وتكفل محاية احلقوق واحلرايت األساسية لألفراد,وقد تناولت الدراسة املبادئ املرتبطة حبماية املتهم قبل احملاكمة وأثناءها وعلى رأسها الشرعية اإلجرائية وقرينة الرباءة واملساواة أمام القانون وحق الدفاع واملواجهة وعلنية اجللسات. كما تطرقت إىل املبادئ اليت تضمن حسن سري العدالة واملتمثلة يف استقالل القضاء وحياد القاضي وتسبيب األحكام واحرتام اآلجال املعقولة وطرق الطعن يف األحكام اجلزائية. وخلصت الدراسة إىل أن قانون اإلجراءات اجلزائية رقم25-14قد كرس خمتلف مبادئ احملاكمة العادلة وعزز الضماانت اإلجرائية املقررة للمتقاضني مبا يسهم يف حتقيق التوازن بني فعالية العدالة اجلزائية ومحاية احلقوق واحلرايت األساسية ومبا ينسجم مع التوجهات احلديثة للسياسة اجلنائية واملعايري القانونية املعاصرة. This study examines the principles of a fair trial under Algerian Criminal Procedure Law No. 25-14 through an analysis of the main procedural guarantees established by the Algerian legislator throughout the different stages of criminal proceedings. It aims to highlight the extent to which this law responds to the requirements of a fair trial by examining the principles governing criminal procedures and ensuring the protection of fundamental rights and freedoms. The study addressed the principles related to the protection of the accused before and during trial including procedural legality the presumption of innocence equality before the law the right of defense confrontation and the publicity of hearings. It also examined the principles that ensure the proper administration of justice namely judicial independence judicial impartiality the reasoning of judgments respect for reasonable time limits and methods of appeal. The study concluded that Criminal Procedure Law No. 25-14 has effectively enshrined the principles of a fair trial and strengthened the procedural guarantees granted to litigants thereby contributing to a balance between the effectiveness of criminal justice and the protection of fundamental rights and freedoms in accordance with modern criminal policy and contemporary legal standards |
