ملخص : تتناول هذه المذكرة موضوع رقمنة قطاع العدالة في الجزائر، من خلال دراسة الإطار المفاهيمي والقانوني لهذه العملية، وكذا تحليل أهم صورها وأدواتها داخل المرفق القضائي، مع إبراز الأساس القانوني والتنظيمي الذي اعتمدته الدولة لتكريس القضاء الإلكتروني. كما تبحث في انعكاسات الرقمنة على المبادئ الأساسية للتقاضي، خاصة مبدأ الوجاهية وحق الدفاع والعلنية والمساواة بين الخصوم، إضافة إلى التحديات القانونية والتقنية المرتبطة بالإثبات الإلكتروني وحماية المعطيات الشخصية ومتطلبات الأمن السيبراني. وتخلص الدراسة إلى أن رقمنة العدالة تمثل خطوة محورية نحو تحديث المرفق القضائي وتحسين فعاليته، لكنها تظل مرتبطة بضرورة توفير ضمانات قانونية وتقنية كفيلة بحماية حقوق المتقاضين وضمان محاكمة عادلة ومتوازنة في البيئة الرقمية.
This thesis addresses the topic of the digitalization of the justice sector in Algeria, through the study of the conceptual and legal framework of this process, as well as the analysis of its main forms and tools within the judicial system, highlighting the legal and regulatory basis adopted by the state to consolidate electronic justice. It also examines the impact of digitalization on the fundamental principles of litigation, especially the principle of adversarial proceedings, the right to defense, publicity, and equality between parties, in addition to the legal and technical challenges related to electronic evidence, personal data protection, and cybersecurity requirements. The study concludes that the digitalization of justice represents a pivotal step toward modernizing the judicial system and improving its efficiency; however, it remains dependent on the provision of legal and technical safeguards capable of protecting litigants’ rights and ensuring a fair and balanced trial in the digital environment. |
