ملخص
تتناول هذه المذكرة دور المحكمة الدستورية في حماية الحقوق والحريات في النظام الدستوري الجزائري، خاصة في ظل التعديل الدستوري لسنة 2020. في الفصل الأول، تعالج الدراسة الإطار المفاهيمي والقانوني للمحكمة الدستورية من خلال تعريفها ونشأتها في الجزائر، إضافة إلى تشكيلتها وشروط العضوية فيها. كما تتناول مفهوم الحقوق والحريات في الدستور الجزائري وتصنيفها إلى حقوق مدنية وسياسية وحقوق اقتصادية واجتماعية. أما الفصل الثاني، فيركز على الآليات التي تعتمدها المحكمة الدستورية لحماية الحقوق والحريات، خصوصًا الرقابة على دستورية القوانين بنوعيها السابقة واللاحقة عبر آلية الدفع بعدم الدستورية، مع بيان شروطها وآثارها. كما يبرز دورها في تفسير الدستور، والفصل في الخلافات بين السلطات، وضمان نزاهة العملية الانتخابية من خلال الرقابة على النتائج والطعون. وتخلص الدراسة إلى أن المحكمة الدستورية تلعب دورًا محوريًا في ترسيخ مبدأ سمو الدستور وحماية الحقوق والحريات وضبط التوازن بين السلطات في الدولة. This dissertation examines the role of the Constitutional Court in protecting rights and freedoms within the Algerian constitutional system, particularly under the 2020 constitutional amendment. The first chapter addresses the conceptual and legal framework of the Constitutional Court by presenting its definition, establishment in Algeria, composition, and membership conditions. It also discusses the concept of rights and freedoms in the Algerian Constitution and their classification into civil, political, economic, and social rights. The second chapter focuses on the mechanisms used by the Constitutional Court to ensure the protection of rights and freedoms, especially constitutional review of laws through both prior and subsequent review, including the mechanism of the plea of unconstitutionality. The study also highlights the Court’s role in interpreting constitutional provisions, resolving disputes between constitutional authorities, and ensuring the integrity of the electoral process through monitoring election results and electoral appeals. The study concludes that the Constitutional Court plays a fundamental role in guaranteeing the supremacy of the Constitution, protecting rights and freedoms, and maintaining the balance between state authorities. |
