تتناول هذه الدراسة موضوع الرعاية الدولية للاستثمارات الأجنبية باعتبارها إحدى الآليات الأساسية في القانون الدولي الاقتصادي لتوفير بيئة قانونية آمنة وجاذبة للاستثمار. وتهدف إلى بيان مفهوم الرعاية الدولية وتمييزها عن الحماية الدولية، مع تتبع تطورها وآلياتها القانونية والمؤسساتية، ولا سيما الاتفاقيات الدولية وتسوية المنازعات والتحكيم الدولي. كما تبرز دور الاتفاقيات الاستثمارية في ضمان المعاملة العادلة والمنصفة وحماية المستثمر من المصادرة والإجراءات التعسفية، إلى جانب أهمية المؤسسات الدولية في الحد من المخاطر غير التجارية وتشجيع تدفقات الاستثمار. وتخلص الدراسة إلى أن فعالية الرعاية الدولية تتوقف على التزام الدول بتعهداتها الدولية وتحقيق التوازن بين حماية المستثمر واحترام سيادة الدولة المضيفة ومصالحها الوطنية، بما يسهم في دعم التعاون الاقتصادي والتنمية المستدامة.
Abstract This study examines the international protection of foreign investments as one of the key mechanisms of international economic law for creating a secure and attractive legal environment for investment. It aims to clarify the concept of international protection and distinguish it from diplomatic protection, while tracing its development and examining its main legal and institutional mechanisms, particularly international investment agreements, dispute settlement mechanisms, and international arbitration. The study also highlights the role of investment agreements in ensuring fair and equitable treatment and protecting foreign investors against expropriation and arbitrary measures, as well as the importance of international institutions in mitigating non-commercial risks and promoting investment flows. The study concludes that the effectiveness of international investment protection depends on States’ compliance with their international obligations and their ability to strike a balance between protecting foreign investors and safeguarding the sovereignty and national interests of host States, thereby contributing to international economic cooperation and sustainable development. |
