تعالج هذه المذكرة موضوع آليات ضبط ومراقبة السوق المالي في التشريع الجزائري، من خلال دراسة الإطار القانوني والتنظيمي المنظم للسوق المالي وبورصة الجزائر، وبيان دور الهيئات الرقابية، وعلى رأسها لجنة تنظيم عمليات البورصة ومراقبتها، في ضمان شفافية المعاملات المالية، وحماية المستثمرين، وتعزيز استقرار السوق المالي. وقد خلصت الدراسة إلى أن المشرع الجزائري أرسى منظومة قانونية ومؤسساتية تهدف إلى تنظيم السوق المالي ومراقبته، إلا أن فعالية هذه الآليات تظل رهينة بتطوير السوق المالي، وتحيين المنظومة التشريعية والتنظيمية، وتعزيز مناخ الاستثمار وثقة المتعاملين في السوق.
Abstract This dissertation examines the mechanisms for regulating and supervising the financial market under Algerian legislation. It analyzes the legal and institutional framework governing the Algerian financial market and the Algiers Stock Exchange, with particular emphasis on the role of the Commission for the Organization and Supervision of Stock Exchange Operations (COSOB) in ensuring market transparency, protecting investors, and maintaining market stability. The study concludes that the Algerian legislator has established a legal and institutional framework for regulating and supervising the financial market. However, the effectiveness of these mechanisms remains closely linked to the development of the financial market, the modernization of the legal framework, and the strengthening of investor confidence and the investment climate. |
