ملخص:تتناول
هذه الدراسة موضوعتوزيع االختصاص بني قطيبالسلطة التنفيذية يف ظل التعديل الدستوري لسنة2020، من خالل بيان طبيعة االختصاصات الدستورية املخولة لكل من رئيس اجلمهورية والوزير األول أو رئيس احلكومة حسب احلالة، وحتليل مظاهر توزيعها وحدودها يف خمتلف اجملاالت السياسية والتنفيذية والتنظيمية. كزت الدراسة على اختصاصات رئيس اجلمهورية يف حتديد السياسة اوقد رلعامة للدولة، وتشكيل احلكومة وإهناء مهام أعضائها، وممارسة السلطة التنظيمية واالختصاصات السيادية، إىل جانب دراسة اختصاصات الوزير األول أو رئيس احلكومة يف توجيه وتنسيق ومراقبة العمل احلكومي وتنفيذ القوانني والتنظيمات واإلشراف على اإلدارة العمومية. كما تناولت صور توزيع االختصاص بني قطيب السلطة التنفيذية وآليات التعاون والتنسيق بينهما، مع الوقوف على كزية االختصاص الرائسي على استقاللية احلكومة. وقد خلصت الدراسة إىل أن التعديل الدستوري لسنةأثر مر 2020أقر متييزا بنيمنصب الوزير األول ورئيس احلكومة تبعا لطبيعة األغلبية الربملانية، إال أن توزيع االختصاص ظل يتسم ابلتداخل والتنسيق مع استمرار املكانة احملورية لرئيس اجلمهورية داخل السلطة التنفيذية، مما جيعل حتقيق التوازن بني قطبيها مرتبطا مبدى احرتام احلدود الدستورية لالختصاصات وضمان فعالية آليات التعاون بينهما. Abstract :This study addresses the issue of the distribution of powers between the two poles of the executive authority under the 2020 Constitutional Amendment, by examining the nature of the constitutional powers granted to the President of the Republic and to the Prime Minister or Head of Government, as the case may be, and analyzing the manifestations and limits of this distribution across the political, executive, and regulatory fields. The study focuses on the powers of the President of the Republic in determining the general policy of the State, forming the Government and terminating the functions of its members, exercising regulatory authority, and assuming sovereign powers. It also examines the powers of the Prime Minister or Head of Government in directing, coordinating, and supervising governmental action, implementing laws and regulations, and overseeing public administration. Furthermore, the study addresses the forms of power distribution between the two poles of the executive authority and the mechanisms of cooperation and coordination between them, while examining the impact of the centralization of presidential powers on the autonomy of the Government. The study concludes that the 2020 Constitutional Amendment established a distinction between the position of Prime Minister and that of Head of Government according to the nature of the parliamentary majority. However, the distribution of powers remains characterized by overlap and coordination, while the President of the Republic continues to occupy a central position within the executive authority. Consequently, achieving a balance between its two poles depends on respecting the constitutional boundaries of their respective powers and ensuring the effectiveness of the mechanisms of cooperation between them. |
