| Résumé : |
Abstract: This study addresses the issue of cybercrime and the mechanisms for combating it under Algerian legislation by examining its concept and characteristics and distinguishing it from traditional crime, while highlighting the main criteria for its classification and its various forms, particularly crimes against automated data processing systems, crimes involving property, and crimes against individuals. The study also examines the legal framework adopted by the Algerian legislator to combat these crimes through the substantive protection of information systems under intellectual property legislation, the Penal Code, and the Law on the Prevention of Offences Related to Information and Communication Technologies. In addition, it addresses the criminal and procedural mechanisms, including primary and supplementary penalties, investigation and inquiry procedures, the search for and seizure of electronic evidence, as well as the evidentiary value of electronic evidence and the procedures for preserving it. The study aims to highlight the extent to which legal provisions and procedural mechanisms complement each other in combating cybercrime, given the technical nature of these crimes, the difficulties involved in detecting and proving them, and their transnational character. |
