| Résumé : |
Abstract: This study addresses the issue of international liability for damage arising from space activities, as one of the modern legal subjects imposed by the rapid development in the field of space exploration and its use. The study aims to clarify the international legal framework governing liability for space damage, by addressing the legal basis of liability, particularly absolute liability and fault-based liability, and by presenting the most important relevant international conventions, foremost among them the Outer Space Treaty of 1967 and the Liability Convention of 1972. The study also highlights the forms of damage that may arise from space activities, the rules applicable to determining liability and the mechanisms for reparation of damage, while emphasizing the role of Algerian legislation in regulating space activities. The study concludes that the international regime of space liability is based on specific rules that take into account the nature of space activities and their risks, with the aim of achieving a balance between encouraging the peaceful use of outer space and ensuring the protection of States, persons and property from the damage arising therefrom. |
