الملخص:
تعد القضايا الجنائية من أكثر القضايا حساسية وخطورة، الأمر الذي دفع أغلب التشريعات إلى منح القاضي الجزائي صلاحيات تقديرية واسعة في التعامل مع مختلف عناصر الدعوى الجزائية. وتتيح له هذه الصلاحيات تحديد الوصف القانوني الصحيح للجريمة، وتقييم أدلة الإثبات، ومن ثم اختيار لجزاء المناسب وتوقيعه بما يحقق العدالة. إلا أن هذا التوسّع في منح السلطة التقديرية قد يفتح المجال أمام احتمالات التحكم أو الاستبداد القضائي، مما قد يهدد حقوق الأفراد وحرياتهم. ومن هنا تبرز الحاجة الملحة إلى وجود ضوابط قانونية واضحة تؤطر هذه السلطة، بما يضمن حسن استخدامها، ويحول دون التعسف أو الانحراف في تطبيقها، تحقيقًا للتوازن بين سلطة القاضي وحماية حقوق المتقاضين. Abstract: Criminal cases are among the most sensitive and serious types of legal disputes, which has led most legislations to grant riminal judges broad discretionary powers in handling the various elements of a criminal case. These powers allow the judge to determine the proper legal classification of the offense, assess the evidence presented, and accordingly select and impose the appropriate and just penalty. However, such broad discretionary authority may open the door to potential judicial arbitrariness or abuse of power, which could endanger individual rights and freedoms. Therefore, there is an urgent need for clear legal safeguards that regulate and frame this discretionary power, in order to ensure its proper use, prevent any misuse or deviation, and strike a balance between judicial authority and the protection of litigants' rights |
