الملخص :
تصنف جريمة الإتجار بالبشر على أنها من أخطر الجرائم العابرة للحدود حيث تحتل المرتبة الثالثة عالميا بعد التجارة المخدرات والسلاح وتستهدف كرامة الإنسان عبر إستغلاله في الأعمال القسرية أو الجنسية وحتى تجارة الأعضاء وقد تطورت هذه الجريمة من أشكال الرق التقليدية إلى شبكات معقدة مستفيدة من سوء الظروف التي يعاني منها الضحايا في كافة مجالات الحياة تاركة وراءها مجتمع مدمر وفي إطار مكافحتها على المستوى الدولي تم وضع إطار قانوني متين متمثل في بروتوكول باليرمو الملحق بإتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة والذي وضع تعريفا شاملا للجريمة وشدد على ضرورة تعاون الدول في مكافحتها ومشى المشرع الجزائري على نفس النهج وإستجاب للمتطلبات الدولية من خلال إصدار قانون 23-04 والذي تبنى سياسة عقابية صارمة للقضاء عليها مع تعزيزه للآليات الوقائية والحمائية لإعادة إدماج الضحايا ومساعدتهم ، في محاولة فعالة ومحكمة للقضاء على الجريمة . Abstract: Human trafficking is classified as one of the most serious transnational crimes, ranking third globally after drug and arms trafficking. It targets human dignity through exploitation in forced or sexual labor, and even organ trafficking. This crime has evolved from traditional forms of slavery into complex networks that exploit the poor conditions of victims in all areas of life, leaving behind a devastated society. To combat it at the international level, a robust legal framework has been established, represented by the Palermo Protocol to the United Nations Convention against Transnational Organized Crime. This protocol provides a comprehensive definition of the crime and emphasizes the need for countries to cooperate in combating it. Algerian lawmakers have followed suit and responded to international requirements by issuing Law 23-04, which adopted a strict punitive policy to eradicate it while strengthening preventive and protective mechanisms to reintegrate and assist victims, in an effective and concerted effort to eradicate the crime. |
