ملخص:
يخضع الموظف العمومي حـين تعيينـه لممارسـة وظيفتـه بصـفة شـرعية لجملـة اجـراءات إدارية يكفلها القانون ، غير أنـه تـرد أحيانـا بعـض الظـروف غيـر المـتحكم بهـا تسـتدعي ممارسـة هـــذا الشـــخص لوظيفتـــه دون تعيـــين أو تفـــويض يطلـــق عليهـــا نظريـــة الموظـــف الفعلـــي والتـــي وضعت تطبيقا لمبدأ استمرار سـير المرافـق العامـة فـي بعـض الظـروف الإسـتثنائية مثـل الحـروب والثـورات حيـث تبـرز الحاجـة لإدارة مرفـق عـام مـن قبـل الأفراد مـن دون اذن مسـبق مـن السـلطة الإدارية لذا فقد اعترف الفقه والقضاء بالتصرفات التـي يقـو م بهـا الشـخص فـي هـذه الحالـة خلافـا للأصل وكذا الحال بالنسبة لبعض الأثار القانونية المترتبة على تلك التصرفات. الكلمـــات المفتاحيـــة: القـــانون الإداري، الموظـــف العمـــومي، الموظـــف الفعلـــي،الإدارة، المرفـــق العام. Summary When a public servant is appointed to practice his or her employment legitimately, he has been subjected to a number of procedures guaranteed by administrative law, but sometimes there are some uncontrolled circumstances that require the exercise of his function without appointment or delegation called the theory of the actual employee, which has developed an application of the principle of the continued functioning of public utilities in some exceptional circumstances such as wars and revolutions where there is a need to manage a public facility by individuals without the prior permission of the administrative authority. It is carried out by the person in this case contrary to the original and so are some of the legal effects of such conduct.
