ملخص:
تُعد الثورة الرقمية من أهم المستجدات التي طرأت على الواقع الاجتماعي والاقتصادي في العصر الحديث وقد فرضت تحولات جوهرية على الأنظمة القانونية والتشريعية، خصوصًا في مجال تنظيم المعاملات الإلكترونية. ومن بين الآليات التي اكتسبت أهمية بارزة في هذا السياق؛ يبرز "التوقيع الإلكتروني" باعتباره عنصراً محورياً في ضمان صحة وسلامة التعاملات الرقمية، وهو ما يجعل دراسته من الزوايا القانونية والتقنية أمراً ذا بالغ الأهمية. هدفت هذه الدراسة إلى "تحليل دور التوقيع الإلكتروني كآلية حديثة لحماية المعاملات الإلكترونية" وتقييم مدى قدرته على تحقيق الأمن القانوني للمتعاملين، مع تسليط الضوء على المقومات الأساسية التي تضمن مصداقيته وحجيته أمام الجهات القضائية. كما سعت الدراسة إلى إبراز الثغرات التشريعية والفنية التي قد تحد من فعاليته، خاصة في البيئة العربية، وذلك في مقابل التشريعات الدولية الأكثر تطوراً في هذا المجال. Abstract: The digital revolution represents one of the most significant developments that have impacted the social and economic realities of the modern era. It has imposed fundamental transformations on legal and legislative systems, particularly in the field of regulating electronic transactions. Among the mechanisms that have gained prominent importance in this context, "electronic signature" emerges as a central element in ensuring the integrity and security of digital transactions, making its study from both legal and technical perspectives a matter of utmost importance. This study aimed to "analyze the role of the electronic signature as a modern mechanism for securing electronic transactions", and to assess its effectiveness in achieving legal security for transacting parties. It also sought to highlight the essential requirements that ensure the credibility and evidentiary value of the electronic signature before judicial authorities. Furthermore, the study aimed to shed light on the legislative and technical shortcomings that may hinder its effectiveness particularly within the Arab legal environment in comparison with more advanced international legal frameworks in this field. |
