ملخص: تشكل المسؤولية الدولية للدول عن الضرر البيئي إطارًا قانونيًا يحدد التزامات الدول تجاه البيئة وحماية الموارد الطبيعية من الأضرار العابرة للحدود. يشمل النظام القانوني لهذه المسؤولية مفهومها العام وتمييزها، مع التركيز على تطور آثارها البيئية، وأسُسها مثل نظرية الخطأ، المسؤولية عن الأعمال غير المشروعة، والأضرار الناتجة عن الأنشطة الخطرة. كما يتناول الاتجاه الموضوعي للمسؤولية الدولية، موضحًا المسؤولية الموضوعية )نظرية المخاطر( والمبادئ التقليدية والحديثة، مع تحليل آليات التعويض عن الضرر البيئي بما في ذلك التعويض العيني والنقدي، وأنظمة التأمين وصناديق التعويض، لضمان حماية فعالة للبيئة وتعويض المتضررين.
Summary: The international responsibility of states for environmental damage constitutes a legal framework that defines the obligations of states toward the environment and the protection of natural resources from transboundary harm. The legal system of this responsibility includes its general concept and distinction, with a focus on the evolution of its environmental impacts, and its foundations such as the theory of fault, responsibility for unlawful acts, and damage resulting from hazardous activities. It also addresses the objective orientation of international responsibility, explaining strict liability (the risk theory) and both traditional and modern principles, along with an analysis of mechanisms for compensation for environmental damage, including in-kind and monetary compensation, insurance systems, and compensation funds, to ensure effective environmental protection and redress for the affected parties. |
