ملخص :
في هذه المذكرة بالدراسة والتحليل تناولنا آليات الرقابة القضائية على أعمال الإدارة في ضوء التعديل الدستوري الجزائري لسنة 2020، وذلك عبر تقسيمها إلى مبحث تمهيدي و فصلين رئيسيين؛ يبدأ المبحث التمهيدي بتوضيح مفهوم الرقابة القضائية وتمييزها عن الرقابات الأخرى ف، ومبدأ المشروعية وفق دستور 1996والقضاء الإداري وفق التعديل الدستوري 2020 ،. أما الفصل الأول فتطرقنا إلى آليات الرقابة القضائية على الأعمال الإدارية، من خلال مختلف الدعاوى الإدارية كدعوى الإلغاء، ودعاوى القضاء الكامل، والدعاوى الإستعجالية ، مما يعكس مدى تطور رقابة القضاء الإداري على تصرفات الإدارة حمايةً للحقوق والحريات. ويأتي الفصل الثاني ليركز على معوقات الرقابة القضائية العملية المتعلقة بالشروط والآجال والصعوبات المادية والبشرية. Summary: "In this thesis, we have studied and analyzed the mechanisms of judicial oversight over administrative actions in light of the 2020 Algerian Constitutional Amendment. The study is structured into a preliminary chapter and two main chapters. The preliminary chapter begins by clarifying the concept of judicial oversight, distinguishing it from other types of oversight, the principle of legality under the 1996 Constitution, and administrative justice according to the 2020 Constitutional Amendment. The first chapter addresses the mechanisms of judicial oversight over administrative acts through various administrative lawsuits, such as annulment actions (recours en annulation), full jurisdiction actions (plein contentieux), and summary proceedings (référé). This reflects the extent of the development of administrative judiciary oversight over administration conduct to protect rights and freedoms. Finally, the second chapter focuses on the practical obstacles to judicial oversight related to procedural conditions, time limits, and material and human difficulties. |
