الملخص
تتناول هذه الدراسة أحكام الضمان في قواعد حماية المستهلك، حيث لا يقتصر التزام المتدخل على تسليم المنتوج مقابل الثمن، بل يمتد ليشمل ضمان خلوه من العيوب ومطابقته للصفات المتفق عليها. ونظرًا لقصور القواعد العامة في توفير الحماية القانونية للمستهلك باعتباره الطرف الضعيف تدخل المشرع الجزائري بموجب القانون رقم 09-03 لإعادة التوازن في العلاقة الاستهلاكية. وقد أقر المشرع إلزامية الضمان للمنتوجات الموجهة للاستهلاك، فلم يعد يقتصر على المنتوجات المعيبة فقط، بل يشمل أيضًا غير المطابقة، وجعله من النظام العام، مع توسيع نطاقه الشخصي والموضوعي. كما وضع آليات رقابية وقضائية لضمان تطبيقه، تمكّن المستهلك من الحصول على حقه في إصلاح المنتوج أو استبداله أو رد ثمنه. وفي حالة الإخلال بهذا الالتزام، رتب المشرع جزاءات مدنية وجزائية (غرامات وحبس) وإدارية (سحب المنتوج وغلق المحل التجاري)، بهدف ضمان فعالية الحماية وترسيخ مبدأ حماية الطرف الضعيف في العلاقة الاستهلاكية. Abstract : This study addresses warranty provisions under consumer protection law where the professional’s obligation is not limited to delivering the product for its price, but also includes ensuring that it is free from defects and conforms to agreed specifications. Due to the insufficiency of general contract rules in protecting consumers as the weaker party, the Algerian legislator intervened through Law No. 09-03 on consumer protection and fraud repression to restore balance in consumer relations. The legislator has made the warranty mandatory for consumer products extending it to both defective and non-conforming goods, and has classified it as a matter of public order. Its scope has been broadened in both personal and material terms. Control and judicial mechanisms have been established to ensure its application, enabling consumers to obtain repair, replacement, or refund. In case of breach of this obligation, civil, criminal (fines and imprisonment), and administrative sanctions (product withdrawal and closure of premises) are provided to ensure effective protection and to reinforce the principle of protecting the weaker party in contractual relations. |
