تناولتهذهالدراسةموضوعالحمايةالقانونيةللمستهلكفيظلنظامالدفعالإلكتروني،وذلكبهدفتسليطالضوءعلىالآلياتالتشريعيةالتيأقرهاالمشرعالجزائريلمواجهةالمخاطرالجنائيةوالمدنيةالمرتبطةبالرقمنةالمالية.وقدتمالتركيزفيالقسمالأولعلىالتكييفالجنائيللجرائمالمعلوماتيةالمستحدثةوخصوصيةالدليلالرقميفيإثباتها،بينماعالجالقسمالثانيقواعدالمسؤوليةالمدنيةوالآلياتالوقائيةالكفيلةبحمايةالمستهلكوجبرأضراره.وقدخلصتالدراسةإلىضرورةتحديثالمنظومةالقانونيةبمايتماشىمعتسارعالتقنياتالرقمية،وتعزيزنظامالمسؤوليةالموضوعيةللمؤسساتالمصرفيةلضمانأمنوحقوقالمستهلكالإلكتروني. Abstract Thisstudyexaminesthelegalprotectionofconsumerswithintheelectronic paymentsystem,aimingtohighlightthelegislativemechanismsestablished byAlgerian law to address the criminal and civil risks associated with financialdigitalization.Thefirstpartfocusesonthelegalcharacterizationof emerging cybercrimes and the specificity of digital evidence in criminal proceedings.Thesecondpartexplorestherulesofcivilliabilityandthe preventive mechanisms designed to protect consumers and ensure compensation for damages. The study concludes that it is essential to modernizethelegalframeworktokeeppacewithrapiddigitaladvancements and to strengthen the objective liability of banking institutions to ensure the .securityandrightsofelectronicconsumers |
