ملخص الدراسة
تناولت هذه الدراسة الإطار القانوني للدفاتر التجارية وحجيتها في الإثبات وفقاً للتشريع الجزائري، مع التركيز على الجزاءات المترتبة على الإخلال بمسكها. تهدف الدراسة إلى تبيان كيفية تنظيم المشرع لالتزام التاجر بمسك الدفاتر التجارية، سواء كانت تقليدية أو إلكترونية، ومدى خروجه عن القواعد العامة للإثبات في القانون المدني من خلال منح التاجر إمكانية الاستناد إلى دفاتره كدليل لمصلحته. وقد خلصت الدراسة إلى أن الدفاتر التجارية تعد المرآة العاكسة للمركز المالي للتاجر، وأن حجيتها في الإثبات مرتبطة بمدى انتظامها واستيفائها للشروط القانونية. كما سلطت الضوء على صرامة الجزاءات المدنية والجزائية (خاصة في حالات التفليس) التي أقرها المشرع لضمان انضباط التجار، مع الإشارة إلى الدور المتنامي للدفاتر الإلكترونية في ظل التحول الرقمي للمعاملات التجارية. Abstract This study examines the legal framework of commercial books and their probative value in evidence under Algerian legislation, focusing on the sanctions resulting from the failure to maintain them. The study aims to clarify how the legislator regulates the merchant's obligation to keep commercial books—whether traditional or electronic—and the extent to which it deviates from the general rules of evidence in civil law by allowing merchants to rely on their own records as evidence in their favor. The study concludes that commercial books serve as a reflection of the merchant's financial position, and their legal admissibility is strictly linked to their regularity and compliance with legal requirements. It also highlights the severity of the civil and criminal sanctions (particularly in cases of bankruptcy) imposed by the legislator to ensure professional discipline. Furthermore, the study addresses the growing role of electronic commercial books in light of the digital transformation of commercial transactions. |
