ملخص:
تتمحور هذه الدراسة حول اآلليات القانونية ملواجهة اجلرائم اإللكرتونية املاسة باملعامالت التجارية، حيث تسعى لتقييم مدى جناعة املنظومة التشريعية اجلزائرية، السيما بعد تعديالت عام2024، يف خلق توازن معقد بني ضرورة الردع اجلنائي وبني صون كرامةكيز، التزاما باألمانة العلمية، على حتليلاإلنسان وحقوقه يف الفضاء الرقمي. وينصب الرت القواعد املوضوعية واإلجرائية املستحدثة حلماية االئتمان التجاري وتعزيز الثقة يف السوق االفرتاضي، مع تبيان كيف ع لتطويع النصوص القانونية ملالحقة "الدليل الرقمي" السعى املشرعابر للحدود دون املساس حبرمة احلياة اخلاصة. وخيلص البحث إىل أن بناء بيئة جتارية رقمية آمنة يتطلب تكامال بني صرامة القانون والتعاون الدويل الفاعل، مبا يضمن كرا سيادة العدالة ومحاية األفراد من التغول اإلجرامي التقين، ترسيخا ملبادئ دولة القانون اليت جتعل منمة اإلنسان غاية أمسى لكل تشريع. ABSTRACT This study centers on the **legal mechanisms for combating cybercrimes affecting commercial transactions**, seeking to evaluate the efficacy of the Algerian legislative framework—particularly following the **2024 amendments**—in establishing a complex balance between the necessity of criminal deterrence and the preservation of human dignity and rights within the digital sphere. Committed to scientific integrity, the focus is placed on analyzing the newly introduced substantive and procedural rules designed to protect commercial credit and bolster trust in the virtual market. Furthermore, it demonstrates how the legislator sought to adapt legal provisions to pursue transboundary "digital evidence" without infringing upon the sanctity of private life. The research concludes that building a secure digital commercial environment requires integration between legal rigor and effective international cooperation, thereby ensuring the rule of law and protecting individuals from technical criminal encroachment, in reinforcement of the principles of a constitutional state that regards human dignity as the ultimate goal of all legislation. |
