الملخص : تتناول هذه المذكرة دراسة مبدأ الملوِّث الدافع في التشريع الجزائري باعتباره من المبادئ الأساسية في القانون البيئي المعاصر الهادفة إلى تحقيق التوازن بين متطلبات التنمية الاقتصادية وحماية البيئة، وذلك من خلال تحليل إطاره المفاهيمي وبيان أسسه وتطوره، ثم دراسة مدى تكريسه ضمن المنظومة القانونية الوطنية وتقييم فعالية الآليات القانونية والجبائية المعتمدة لتطبيقه على أرض الواقع. وقد اعتمدت الدراسة على المنهج الوصفي والمنهج التحليلي لبحث النصوص القانونية المنظمة لحماية البيئة في الجزائر، وتوصلت إلى أن المشرّع الجزائري كرّس هذا المبدأ ضمن عدة نصوص، غير أن فعالية تطبيقه ما تزال تواجه تحديات مرتبطة بضعف الرقابة وصعوبة تقييم الأضرار البيئية ونقص الوعي البيئي، الأمر الذي يستدعي تعزيز الإطار التشريعي وتفعيل آليات الرقابة ونشر الثقافة البيئية لتحقيق حماية قانونية فعالة للبيئة.
Abstract: This paper examines the polluter pays principle in Algerian legislation as one of the fundamental principles of contemporary environmental law aimed at achieving a balance between the requirements of economic development and environmental protection. This is done by analyzing its conceptual framework, explaining its foundations and evolution, and then studying the extent to which it is enshrined within the national legal system, as well as evaluating the effectiveness of the legal and fiscal mechanisms adopted for its application on the ground. The study adopted a descriptive and analytical approach to examine the legal texts governing environmental protection in Algeria. It concluded that the Algerian legislator has enshrined this principle in several texts; however, the effectiveness of its application still faces challenges related to weak monitoring, difficulty in assessing environmental damage, and lack of environmental awareness. This calls for strengthening the legislative framework, activating monitoring mechanisms, and spreading environmental culture to achieve effective legal protection for the environment. |
