الملخص
يشهد أمن المعلومات في العصر الحديث أهمية متزايدة باعتباره من أبرز التحديات القانونية والتقنية التي فرضها التطور الرقمي المتسارع، خاصة مع الانتشار الواسع لتقنيات الذكاء الاصطناعي، فقد ساهمت هذه التقنيات في تعزيز حماية الأنظمة المعلوماتية من خلال الكشف المبكر عن التهديدات السيبرانية، تحليل المخاطر الرقمية، والاستجابة السريعة للهجمات الإلكترونية، مما أدى إلى رفع مستوى فعالية الأمن السيبراني وتحسين آليات حماية البيانات. وفي المقابل أثار استخدام الذكاء الاصطناعي العديد من الإشكالات القانونية المرتبطة بحماية المعطيات الشخصية والحق في الخصوصية داخل البيئة الرقمية، الأمر الذي يفرض ضرورة تطوير الأطر القانونية بما يواكب التحولات التكنولوجية الحديثة، ففعالية أمن المعلومات لا تتحقق فقط بالاعتماد على الوسائل التقنية المتطورة، وإنما تتطلب أيضاً توفير حماية قانونية صارمة تضمن مكافحة الجرائم الإلكترونية وتنظيم استخدام البيانات الرقمية ، و من جهة أخرى فان تحقيق أمن معلومات فعال يستوجب ايجاد توازن بين متطلبات الأمن الرقمي داخل البيئة الرقمية. وتهدف هذه الدراسة إلى إبراز مدى إسهام تقنيات الذكاء الاصطناعي في ضمان وتعزيز أمن المعلومات وحماية البيانات، وبيان دورها في حفظ سرية المعلومات وسلامتها وتوافرها، مع تقييم مدى كفاية أو قصور الآليات القانونية والتقنية المعتمدة في مواجهة المخاطر والتحديات الناجمة عن استخدام هذه التقنيات، واقتراح السبل الكفيلة بتعزيز الحماية القانونية والتقنية بما يحقق أمنًا معلوماتيًا أكثر فعالية. Abstract Information security has become a critical issue in the contemporary digital era, representing one of the most significant legal and technological challenges arising from rapid digital transformation, particularly with the widespread adoption of Artificial Intelligence (AI) technologies. AI has played a vital role in enhancing the security of information systems by enabling the early detection of cyber threats, analyzing digital risks, and providing rapid responses to cyberattacks. These capabilities have significantly improved the effectiveness of cybersecurity and strengthened data protection mechanisms. However, the increasing use of AI has also generated complex legal challenges concerning the protection of personal data and the right to privacy within the digital environment. Consequently, there is a pressing need to develop legal frameworks capable of keeping pace with technological advancements while ensuring the responsible use of AI technologies. Effective information security depends not only on advanced technological solutions but also on comprehensive legal protection that addresses cybercrime, regulates the processing and use of digital data, and safeguards individuals' fundamental rights. Therefore, achieving a secure digital environment requires striking an appropriate balance between cybersecurity requirements and the protection of privacy and other fundamental rights. This study aims to examine the extent to which artificial intelligence technologies contribute to ensuring and strengthening information security and data protection. It further analyzes their role in maintaining the confidentiality, integrity, and availability of information, while evaluating the effectiveness of the existing legal and technical mechanisms in addressing the risks and challenges associated with the use of these technologies. In addition, the study explores the adequacy of the current regulatory framework and proposes recommendations for enhancing both legal and technical safeguards to achieve a higher level of information security |
